Maine Moving Totes Rental Agreement

Simple Promise: We deliver clean totes, labels, and dollies. You use them for your move and return everything at pickup. No security deposit required. Missing items may incur replacement fees.
This Rental Agreement ("Agreement") is entered into between Maine Moving Totes ("Company," "we," "us," or "our") and the Customer ("Customer," "you," or "your") who completes a reservation through our website or booking platform.
By placing an order with Maine Moving Totes, you acknowledge that you have read, understood, and agree to the terms of this Agreement.
1. Rental Period
All rentals include a standard rental period of three (3) weeks beginning on the scheduled delivery date.
Equipment must be available for pickup on the scheduled pickup date unless an extension has been approved and paid for in advance.
2. Payment
- Full payment is required at the time of booking to reserve your delivery date.
- Reservations are not confirmed until payment has been successfully processed.
- All pricing is subject to applicable Maine sales tax.
3. Delivery & Pickup
Maine Moving Totes will deliver and retrieve rented equipment at the address provided during booking.
Customer agrees to:
- Provide accurate delivery and pickup information.
- Ensure safe and reasonable access to the delivery and pickup location.
- Have all rented equipment empty and ready for pickup at the agreed-upon time.
Additional service fees may apply if delivery or pickup cannot be completed due to lack of access, incorrect information, or customer unavailability.
4. Service Area
- Delivery and pickup are included within ten (10) miles of South Portland, Maine.
- Locations outside of the standard service area may incur additional delivery charges and will be quoted individually.
5. Rush Deliveries
- Deliveries requested within three (3) days of the desired delivery date are considered Rush Deliveries.
- Rush Deliveries are subject to inventory and scheduling availability and require prior approval.
- Approved Rush Deliveries are subject to a $75 Rush Delivery Fee.
6. Rental Extensions
Customers who need additional time may request an extension before their scheduled pickup date.
Extension fees are:
- Apartment Package: $15 per additional week
- Home Package: $25 per additional week
Extensions are subject to inventory availability and are not guaranteed.
7. Ownership of Equipment
All totes, dollies, labels, and related equipment remain the sole property of Maine Moving Totes.
Customer shall not sell, transfer, sublease, modify, destroy, or dispose of any rented equipment.
8. Customer Responsibilities
Customer agrees to:
- Use equipment only for normal moving and storage purposes.
- Exercise reasonable care while equipment is in their possession.
- Protect equipment from theft, misuse, or excessive damage.
- Return all equipment at the conclusion of the rental period.
- Notify Maine Moving Totes promptly if equipment is lost, stolen, or damaged.
9. Missing or Damaged Equipment
Customer is responsible for the replacement cost of equipment that is lost, stolen, destroyed, or damaged beyond normal wear and tear.
Replacement fees are as follows:
- Large Tote (27 Gallon): $15 each
- Medium Tote (12 Gallon): $12 each
- Furniture Dolly: $40 each
Maine Moving Totes reserves the right to charge the payment method on file for replacement costs and any unpaid rental extension fees.
Normal scuffs and wear from ordinary moving use are expected and will not result in charges.
10. Cleaning & Condition
All equipment is cleaned and inspected between rentals.
Customer agrees not to expose equipment to:
- Hazardous materials
- Chemicals
- Paint
- Excessive moisture
- Mold
- Biohazards
- Any condition that renders equipment unsafe for future use
Equipment returned requiring extraordinary cleaning or replacement may result in additional charges.
11. Communications Consent
By placing an order with Maine Moving Totes, Customer consents to receive communications related to their reservation, delivery, pickup, payment, scheduling updates, customer support, account notifications, and other service-related matters.
These communications may be delivered through:
- Phone calls
- Text messages (SMS)
using the contact information provided during booking.
Consent to receive service-related communications is required in order for Maine Moving Totes to fulfill your reservation and provide rental services.
12. Optional Marketing Communications
Customers may separately choose to receive promotional communications from Maine Moving Totes.
If Customer opts in, Maine Moving Totes may send:
- Special offers
- Promotions
- Discounts
- Referral programs
- Seasonal reminders
- New service announcements
- Moving tips and resources
through email and/or text message.
Consent to receive marketing communications is voluntary and is not required to make a purchase. Customers may unsubscribe from marketing communications at any time.
13. Photo Documentation
Customer agrees that Maine Moving Totes may photograph rented equipment during delivery, pickup, inventory counts, quality control inspections, and damage assessments.
Such photographs may be used for:
- Inventory management
- Equipment tracking
- Damage documentation
- Operational recordkeeping
Maine Moving Totes will not use identifiable images of customers, residences, or personal property in advertising or promotional materials without separate consent.
14. Limitation of Liability
Customer assumes responsibility for the safe use of all rented equipment.
Maine Moving Totes shall not be liable for:
- Personal injury
- Property damage
- Loss of property
- Theft
- Consequential damages
- Incidental damages
arising from the use, misuse, loading, unloading, transportation, or storage of rented equipment.
To the maximum extent permitted by law, Maine Moving Totes' liability shall not exceed the amount paid by Customer for the rental.
15. Indemnification
Customer agrees to indemnify and hold harmless Maine Moving Totes, its owners, employees, contractors, and representatives from claims, damages, liabilities, costs, and expenses arising from Customer's use or possession of rented equipment.
16. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Maine.
Any disputes arising under this Agreement shall be resolved in the appropriate courts located within the State of Maine.
17. Acceptance of Agreement
By completing a reservation, submitting payment, and accepting delivery of rented equipment, Customer acknowledges that they have read, understood, and agree to the terms of this Rental Agreement.
